Terms of Service

These Terms of Service ("Terms") govern your access to and use of BusyTruck, including the website at busytruck.io, the browser extension, APIs, and related services (the "Service"), provided by Efirity ("we", "us", or "our").

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

BusyTruck is a load board assistant and related tooling for trucking professionals. Features may include load scoring, filtering, integrations with third-party load boards, and optional email linking for message sync and automated replies. We may add, change, or discontinue features at any time.

You must be able to form a binding contract and use the Service only for lawful business purposes in the trucking / freight industry. You are responsible for account credentials and for activity under your account. Notify us promptly of unauthorized use.

Paid plans, if offered, are billed according to the pricing shown at checkout or in your agreement. Fees are generally non-refundable except where required by law or expressly stated by us. We may change prices with notice for renewal periods.

You agree not to:

• Violate laws, third-party terms (including load boards, Gmail, or other providers), or the rights of others;
• Abuse, reverse engineer, or attempt unauthorized access to the Service or related systems;
• Use the Service to send spam, phishing, or deceptive communications;
• Interfere with other users or overload infrastructure;
• Misrepresent affiliation with BusyTruck or use our branding without permission.

We may suspend or terminate access for violations or risk to the Service or other users.

BusyTruck may integrate with third-party platforms (for example DAT, Truckstop, Google/Gmail, payment processors). Your use of those services is governed by their terms and privacy policies. We are not responsible for third-party services, outages, or policy changes that affect integrations.

If you connect an email account and enable automated replies or syncing, you authorize BusyTruck (and our email infrastructure) to access and act on that mailbox only as needed for the features you enable. You are solely responsible for the content and legality of messages sent from your accounts.

The Service, including software, design, trademarks, and content we provide, is owned by Efirity or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service as permitted by these Terms. You retain rights to data you submit; you grant us a license to process that data to operate the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that load scores, recommendations, or automation will be accurate, complete, or uninterrupted, or that using BusyTruck will result in any particular booking or revenue outcome.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EFIRITY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR ONE HUNDRED US DOLLARS IF YOU HAVE NOT PAID).

You agree to indemnify and hold harmless Efirity and its officers, directors, and employees from claims arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or terminate access immediately for breach, legal risk, or non-payment. Provisions that by nature should survive (including IP, disclaimers, liability limits, and indemnity) will survive termination.

We may update these Terms by posting a revised version on this page and updating the "Last updated" date. Material changes may be communicated by email or in-product notice where appropriate. Continued use after changes constitutes acceptance.

These Terms are governed by the laws applicable to Efirity's principal place of business, without regard to conflict-of-law rules, except where mandatory consumer protections apply in your jurisdiction. Courts in that jurisdiction shall have exclusive venue, subject to applicable law.
